LIABILITY WAIVER & ASSUMPTION OF RISK AGREEMENT

IMPORTANT: PLEASE READ CAREFULLY

By accessing, purchasing, or participating in any services provided by Guiding Paw LLC (“Company,” “we,” “us,” or “our”), including our mobile application, website, virtual training programs, coaching sessions, and any in-person training (collectively, the “Services”), you (“User,” “you,” or “your”) acknowledge and agree to the following:

1. Assumption of Risk

You understand that working with animals, including dogs and cats, involves inherent risks.

These risks may include, but are not limited to:

Bites, scratches, or other injuries

Property damage

Unpredictable animal behavior

Injury to yourself, others, or your pet(s)

You voluntarily assume full responsibility for all risks associated with your participation in the Services and use of any training techniques, tools, or guidance provided.

All training advice, techniques, and content are used at your own risk.

2. User Responsibility for Pet(s)

You acknowledge and agree that:

You are solely responsible for your pet(s) at all times

You will maintain proper control of your pet(s)

You will follow all safety recommendations

You will use appropriate equipment when advised

You understand that failure to follow guidance may increase the risk of injury or undesired outcomes.

3. No Supervision Disclaimer

Guiding Paw LLC provides training through digital and virtual formats and does not provide real-time supervision of your actions.

You are solely responsible for:

Safely implementing all training techniques

Supervising your pet(s) during all training activities

4. No Professional or Veterinary Advice

All information provided through the Services is for educational purposes only.

It is not a substitute for professional veterinary, medical, or behavioral advice.

You should consult a qualified professional when appropriate.

5. Responsibility for Others and Minors

You are responsible for ensuring that any other person interacting with your pet(s), including minors, does so safely and under appropriate supervision.

6. Use Beyond the Platform

This waiver applies to all use of Guiding Paw LLC content, whether used within the Services or independently outside the platform.

7. Release of Liability

To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless Guiding Paw LLC and its owners, employees, contractors, affiliates, and agents from any and all claims, liabilities, damages, losses, or expenses arising out of or related to:

Your participation in the Services

Your pet(s) behavior

Any injury to persons, animals, or property

Use or misuse of training techniques or tools

This includes, without limitation, claims for:

Personal injury

Property damage

Emotional distress

Indirect or consequential damages

This release applies whether such claims arise from negligence or otherwise.

8. Indemnification

You agree to indemnify, defend, and hold harmless Guiding Paw LLC from any claims, damages, costs, or expenses (including reasonable attorneys’ fees) arising from:

Your actions or omissions

Your pet(s) behavior

Your violation of any agreement or applicable law

9. Medical & Veterinary Responsibility

You acknowledge that:

Your pet(s) are healthy and fit for training

Your pet(s) are up to date on vaccinations

You are responsible for all veterinary care and costs

In the event of an emergency, you authorize Guiding Paw LLC to seek veterinary care at your expense if necessary.

10. No Guarantee of Results

Training results vary based on many factors, including consistency and environment.

We do not guarantee specific outcomes.

11. Equipment & Training Tools

You acknowledge that:

Certain tools or techniques may be recommended

Improper use may result in injury

You assume full responsibility for proper use.

12. Third-Party Environments

Training may occur in environments that include:

Public spaces

Other animals

Uncontrolled surroundings

You assume all risks associated with these environments.

13. Limitation of Liability

To the fullest extent permitted by law:

Guiding Paw LLC is not liable for indirect, incidental, or consequential damages

Total liability shall not exceed the amount you paid for the Services

14. Relationship to Other Agreements

This waiver is incorporated into and should be read together with our Terms of Service and Privacy Policy.

15. Governing Law

This Agreement is governed by the laws of the State of Utah, United States.

16. Severability

If any provision of this waiver is found unenforceable, the remaining provisions will remain in full force and effect.

17. Electronic Consent

You agree that electronic acceptance of this waiver, including clicking a checkbox or using the Services, constitutes a legally binding signature.

18. Acknowledgment

By using Guiding Paw LLC Services, you acknowledge that:

You have read and understand this waiver

You voluntarily agree to its terms

You accept full responsibility for all risks involved
